1. Scope

The following terms and conditions apply to all orders via our online shop.

 
2. Contractual partner, customer service

3. Conclusion of a contract

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. By clicking the order button, you are placing a binding order for the goods in the shopping cart. The confirmation of the receipt of the order takes place together with the acceptance of the order by email. The purchase contract is concluded with this email confirmation. The condition for the effective conclusion of the contract is always that the order process is completed when the order is sent.
All agreements, verbal or by telephone, only become binding with the written order confirmation. The dimensions, information, drawings, illustrations and service descriptions contained in catalogs, price lists or the documents belonging to the offer are approximate values ​​customary in the industry, technical and / or design details may differ from the illustrations and be changed.

4. Shipping costs

5. Payment

Payment is made in advance.

If you choose the payment method in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment. Please keep in mind that your order can only be processed once the receipt of payment for your order has been confirmed on our account.

 
6. Cash payment when collecting the goods

7. Retention of Title

The goods remain our property until full payment. If the goods are seized or seized before payment (e.g. if the direct debit is not honored), the customer is obliged to point out the retention of title and must notify us immediately.

 
8. Transport damage

If goods are delivered with obvious transport damage, refuse to accept them or complain about the damage to the deliverer immediately (written notice on the carrier's handover certificate!) And contact us immediately!

 
9. Packaging

Paper, cardboard and plastic packaging are not taken back.

 
10. Notification of defects

The buyer / client must check the goods immediately upon receipt. Both open and hidden defects must be reported within 5 days of receipt of the goods. If no notice of defects is received by the end of this period, all rights to defects are forfeited. The same applies in the case of any other disposition of the goods by the buyer / client.

11. Cancellation policy

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods. The right of withdrawal does not apply to custom-made products that are configured, assembled or converted at the customer's request.

In order to exercise your right of withdrawal, you must send a clear declaration to us (nachher.com, Peter Hornung-Sohner, Auenstr. 58, 80469 Munich, 089/2010874, info@hinterher.com) (e.g. a letter sent by post , Fax or email) of your decision to withdraw from this contract. You can also electronically fill in and submit a clear declaration on our contact page in the Message field. If you make use of this option, we will send you a confirmation of receipt of such a revocation immediately (e.g. by email).

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.



Consequences of withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery we offer have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is earlier.


Notice of cancellation of this contract, send it back to our above address or hand it over. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.


You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.



12. Duty to inform about the ODR regulation

13. Delivery dates

Delivery times are not binding for the supplier. The supplier can exceed a specified delivery period up to a period of 6 weeks. The customer can only set a reasonable grace period after this period has expired. If this grace period expires without result, he has the right to withdraw from the contract.
Any claims of any kind by the buyer / client from delays in delivery are excluded.
The supplier is released from the observance of any delivery period and can withdraw from the contract at any time as soon as the customer is in default of payment from previous orders or with regard to a partial delivery of an order.

14. Other claims for compensation

Claims for damages from delay, from impossibility of performance, from culpable violation of secondary contractual obligations, from negligence when concluding the contract and from tort are excluded, unless they are based on intent or gross negligence on the part of the supplier. Liability for grossly negligent injuries is limited to compensation for the damage foreseeable at the time the contract was concluded.

15. Deviating agreements

Any agreements that differ from these General Terms and Conditions are only valid in writing.
